"One would assume that Gibson, makers of fine guitars, and Activision, publisher of the Guitar Hero franchise, would have a good relationship with each other. After all, Activision licenses classic Gibson guitar designs such as the SG, Xplorer and Les Paul as templates for various Guitar Hero controllers. It seems, however, that Gibson isn't at all satisfied with the arrangement it has with Activision. Gibson has sent a notice to Activision declaring that the games publisher is infringing upon the guitar maker's patent for a concept similar to Guitar Hero."

    Gibson still hasn't successful sued Activision before the closing date. In fact the lawsuit is still ongoing. So, the answer should be NO.

    commercial legal battles are extremely costly. I don't know the full details behind the potential suit, but my guess is that it will not even reach the courts... a settlement is much more likely.

    however, it sounds Gibson Guitar was ripped off by Activision in the deal. My conspiracy mind said Activision already had a plan to kick out Gibson Guitar once the games became popular.

      I doubt it. Currently Activision pay for the "toy guitar design" license to Gibson for their guitar look. People won't find Guitar Hero as appealing if the toy guitar doesn't copy the same look and feel as real guitar. However, I am sure the license isn't much. That's why Gibson is suing for more.

    Seems like Activision infringes half of the patent, but not the whole thing. It is likely the court will rule in favor of Activision.
