"Further to Tiffany sues eBay for TM Infringement and eBay at Tiffany's the US District Court has now decided that the internet auction site eBay has not infringed Tiffany's trade marks by failing to prevent counterfeit Tiffany goods to be sold on its site."

Ebay had their chance to settle, they chose to go to trial. That decision will turn out to be the worst mistake ebay has ever made. Ebay is corrupt and rather than just having this go away they chose to expose themselves which will only lead to 100's of million dollars in additional lawsuits. I give Ebay about a year before they declare bankruptcy. Ebay is the perfect example of how big business must be monitored when the complaints are endless. I don't think that Ebay wants the world to know, but I will be the voice so they do know, that ebay not only has full knowledge of the seller's who cheat and sell knockoffs but they do not do a thing and profit from each sale. So if you ever purchased a fake mccoy cookie jar on ebay and the seller has a private auction to hide your name and they have lots of sales and lots of withdrawn feedbacks, this all means that ebay made money for your loss. They allow this and profit from it.

They have abused their power and have openly stated that they take no responsibility for items sold on their site. I just find it strange that it's legal for ebay to profit off of the millions of fake items sold on their site which they will not be responsible for, they have no problem taking the money and they have no problem letting these sellers continue to put money in their pockets at the consumers expense.

If I am Tiffany, I won't settle. Make a great example for all online market place currently selling fakes. But then, Ebay has a high chance of willing.

Ebay is so screwed if they lose. Does that mean they will have to take off all the luxury product listings from their site? No more LV bags, no more Tiffany's.
