Spanking Kids Becomes Illegal in Canada?

The Canadian Liberal Senator, Celine Hervieux-Payette, is promoting the anti-spanking measure known as Bill S-209. The bill, if passed, would repeal Section 43 of Canada's Criminal Code which permits parents and caregivers to use "reasonable force" when disciplining children.

Some view spanking as abusive and ineffective approach to discipline kids. One would even argue that, 100 years ago, it was legal for a man to hit his wife. On the other hand, some warn that if this bill passes, parents risk losing control over their families. Continued disobedience in a family situation leads to continued disobedience in social situations.

    Spanking, when not using any form of a tool/weapon, is probably the most effective way to get young children's attention. What countries like Canada and New Zealand should worry about is how to prevent any type of physical, emotional, and sexual abuse by parents/caregivers to children, not regular means by which parents use to discipline their children. I see the senator's proposal as some tactic for pub-grab or to win the votes of a fridge group of voters who have many causes they want to support verbally, but would never really move a finger themselves to do anything.

    A similar law was just passed in New Zealand. Despite the fact that 80% of people were against the law. There was a case where a parent was prosecuted for using force to get their 3 year old son off the road. Canadians, just hope you don't go down the same path as New Zealand.

    The Canadian Supreme Court Ruling of a couple of years ago placed a number of restrictions on the rights of parents to spank children: only between the ages of 2 and 12, never with anything but the hand, and in a manner that would be viewed as trifling and transient, ie. no bruising and not excessive. Handicapped children cannot be spanked. I think the present restrictions, given the attitude of most people about spanking, will be viewed as appropriate and reasonable and that there is no need to change the law or ban spanking children outright.
